01 Introduction, Purpose & Legal Effect
These Terms & Conditions ("Terms") govern access to and use of the Moris Poll Pulse website, its publicly available research information, digital services, survey participation facilities, research panel membership services, publications, professional enquiry channels and any additional services expressly made subject to these Terms. Moris Poll Pulse is a research initiative associated with Moris Media. The specific legal entity responsible for operating the relevant service shall be identified in the approved version of these Terms or in the applicable service agreement.
The purpose of these Terms is to establish a clear contractual understanding between the responsible operating entity and persons who access or use the services. They explain the conditions under which research information may be accessed, the responsibilities of survey participants, the limitations associated with published research findings, the protection afforded to intellectual property and confidential materials, and the circumstances in which access may be restricted or services discontinued.
The Platform may serve several categories of users, including general website visitors, individuals participating in surveys, registered Pulse Panel members, journalists, academic researchers, commercial clients, institutional representatives and organisations seeking research services. Not every provision will apply equally to every category of user. Provisions concerning membership apply to members, while provisions concerning commissioned research apply only where a relevant commercial engagement exists.
By using a service that is expressly subject to these Terms, a user agrees to comply with the applicable provisions to the extent that a valid and enforceable agreement has been formed under the relevant law. Where affirmative acceptance is necessary, users may be required to acknowledge these Terms before registration or access to restricted services is permitted.
Nothing in these Terms shall be interpreted as excluding, restricting or overriding any statutory right, consumer protection, privacy entitlement or legal remedy that cannot lawfully be excluded or limited by contract.
02 Identity of the Operator & Contracting Entity
Moris Poll Pulse operates as a research initiative associated with Moris Media. References in these Terms to "Moris Poll Pulse", "we", "us" or "our" mean the legal entity responsible for the particular website service, research activity or contractual engagement, as identified in the applicable documentation.
The identity of the contracting entity is particularly important where services involve different countries, research clients, payment arrangements or personal data processing. A commercial agreement entered into by 1 Moris Media group entity does not automatically create contractual obligations for every other entity associated with the group.
Before these Terms are published, the responsible operator must identify its complete registered legal name, jurisdiction of incorporation, registered office and any legally required business registration particulars. Where a separate entity operates a particular research service, that entity should be identified in the relevant research notice or agreement.
References to Moris Media in marketing materials, website descriptions or research publications should not be interpreted as establishing an unlimited guarantee by every associated company for obligations undertaken by another entity.
For general correspondence, users may contact pollpulse@morismedia.com. Legal correspondence may be directed to legal.pollpulse@morismedia.com once that address has been established and activated. Formal legal notices must be delivered according to the applicable contractual and statutory requirements.
03 Acceptance, Capacity & Applicability
Users who access publicly available content are expected to comply with applicable laws and lawful website-use restrictions. Where a particular contractual obligation requires express acceptance, the responsible operator shall use an appropriate acceptance procedure rather than relying exclusively on passive website browsing.
An individual who creates an account, registers for the Pulse Panel or enters into a research-related agreement represents that they possess the legal capacity required for the relevant transaction. Where an individual acts on behalf of a company, institution, publisher or other organisation, that individual represents that they have appropriate authority to undertake the relevant action.
The Pulse Panel is intended for adults aged 18 or older. This general membership requirement does not prevent separately authorised research involving minors where such research is lawful and conducted with the necessary safeguards, permissions and participant information.
Where separate written terms govern a particular commissioned research project, data licence, professional engagement or paid service, those terms shall govern the specific subject matter they address. These website Terms shall apply only to the extent they are relevant and do not conflict with the properly executed agreement.
If a user does not accept the applicable conditions, the user should refrain from registering for or using the affected service. This does not prevent the user from exercising statutory rights or contacting the responsible operator about a legal or administrative concern.
04 Description of Services
Moris Poll Pulse may provide information and services concerning political and election research, voter opinion studies, public attitudes, consumer preferences, brand awareness, customer experiences, market research, institutional surveys and related research subjects.
Public website services may include descriptions of research activities, published findings, reports, research summaries, charts, questionnaires, methodological explanations and information about available professional services. The website may also provide access to research enquiries, media correspondence, panel registration and other administrative facilities.
Research participation services may enable eligible individuals to receive invitations, complete questionnaires, participate in interviews or contribute information to studies conducted or coordinated by the responsible operator. Participation may occur through online questionnaires, face-to-face interviews, telephone research or other lawful methods.
Commercial services may include commissioned studies, research consultation, questionnaire preparation, fieldwork coordination, data analysis and reporting, where expressly agreed with a client.
The description of a potential service on the website does not establish that the service is continuously available, offered in every jurisdiction or included without charge. Availability depends on actual implementation, operational capacity, applicable law and any relevant agreement.
The operator may develop, modify or discontinue services, subject to existing contractual obligations, applicable notice requirements and mandatory legal protections.
05 Website Access & Permitted Use
The Platform is provided for lawful access to research information and authorised use of its available services. Users may read publicly accessible materials and use available website functions for their intended purposes, subject to applicable intellectual property rights and any clearly disclosed access restrictions.
Users must not interfere with the normal operation of the website, attempt to access restricted information without authorisation or use the services in a manner that compromises the rights or security of other users. Access to a publicly available webpage does not confer permission to obtain restricted databases, internal research records, confidential client materials or private participant information.
Users must not knowingly introduce malicious software, attempt to bypass authentication controls, exploit security vulnerabilities or undertake actions intended to disrupt service availability. Automated access, including scraping or bulk extraction, must comply with applicable law, relevant access restrictions and any required authorisation.
The operator may apply reasonable technical controls to protect website availability, confidential research materials and the integrity of survey participation. Such controls must be exercised consistently with applicable law and legitimate user rights.
Access to the website does not grant any ownership interest in its underlying software, research content, trademarks, databases or other protected materials.
06 Account Registration & Security
Certain services may require users to create an account and provide information reasonably necessary for registration, authentication, eligibility assessment and service administration. Users are responsible for providing accurate information and maintaining appropriate account security.
Where email verification is required, registration may remain incomplete until the user confirms control of the submitted email address. Verification procedures are intended to reduce unauthorised registrations and improve the reliability of membership communications.
Members must not knowingly create duplicate accounts to manipulate research selection, participate repeatedly in a study that permits only 1 response or obtain incentives to which they are not entitled. They must not impersonate another individual or provide fabricated identity information.
Users should take reasonable precautions to protect account credentials and promptly report suspected unauthorised access. The operator may temporarily restrict an account where necessary to investigate a credible security concern or material breach of these Terms.
Account restrictions should be proportionate to the circumstances and should not be used to penalise lawful disagreement, legitimate complaints or the exercise of statutory rights.
A member may request account closure through the relevant procedure. Closure does not automatically require deletion of records that must lawfully be retained or information that has already been irreversibly anonymised. Personal data requests remain governed by the applicable Privacy Policy and law.
07 Pulse Panel Membership
The Pulse Panel is intended to provide interested adults with an opportunity to register for consideration in suitable research studies. Membership does not create employment, agency, partnership or any entitlement to a particular volume of research work.
Registration is intended to be free of charge. Members may provide information concerning their location, preferred language, general interests and other characteristics relevant to determining eligibility for research opportunities.
Research invitations may be issued according to the requirements of individual studies. A member's registration does not guarantee that an invitation will be received, that the member will qualify for a particular study or that participation will be accepted after preliminary screening.
Members may be invited to update their profile information to support appropriate study selection. Additional information should be requested only for legitimate, disclosed purposes and processed according to applicable privacy requirements.
Membership must remain voluntary. Members should be able to manage communication preferences and request withdrawal from future invitations through the available account or support procedures.
The operator may review registrations for eligibility, duplication, misuse or security concerns. Any decision to suspend or terminate membership must comply with applicable law and should be based on legitimate grounds rather than the content of a member's lawful political or consumer opinions.
08 Research Participation & Informed Consent
Research participation is based on the conditions disclosed for the relevant study. Before collecting responses, the responsible research organisation should provide appropriate information about the research purpose, the nature of participation, relevant privacy arrangements and any material conditions.
A participant's decision to take part in 1 study does not automatically authorise participation in another study or the use of their information for unrelated purposes. Where separate consent is required, the relevant consent must be obtained before the applicable processing begins.
Participants are expected to provide responses that reflect their genuine knowledge, experiences and opinions. Deliberately fabricated responses, impersonation, unauthorised automated submissions and attempts to manipulate study results are prohibited.
Some questionnaires may contain eligibility questions, attention checks or other reasonable quality measures. These measures may be used to identify responses that do not satisfy the documented requirements of the study. They must not be applied selectively to remove genuine responses merely because those responses are commercially inconvenient or politically unfavourable.
Participants may discontinue participation according to the applicable study information and law. The extent to which previously submitted information can be withdrawn or deleted depends on whether it remains identifiable and the applicable legal requirements.
Where interviews are recorded, the necessary notices and lawful permissions must be obtained. Agreement to answer research questions does not automatically constitute agreement to audio or video recording.
09 Political Research & Respondent Independence
Political and election research may examine voting intentions, public policy preferences, government performance, leadership approval, constituency concerns and other subjects relevant to public opinion.
Participation in political research does not require support for any particular political party, candidate or organisation. Respondents must be permitted to express their views without coercion, intimidation or pressure to provide a predetermined answer.
Information revealing political opinions may be subject to additional legal protections. The collection, use and disclosure of identifiable political responses must comply with applicable data protection requirements and the specific research notice.
The secrecy of the official ballot must be respected. No participant should be compelled to disclose how they voted or intend to vote. Questions concerning recalled voting behaviour must be administered lawfully and with appropriate safeguards.
Research activities conducted during election periods may be subject to restrictions concerning fieldwork, publication or dissemination. Exit polls and related publications must comply with the laws and directions applicable to the relevant election.
Moris Poll Pulse research should not be represented as an official electoral process or an announcement by an election authority. Publication of political research does not, by itself, constitute endorsement of a party or candidate.
Users must not misuse identifiable research information for unlawful voter intimidation, suppression, discriminatory treatment or undisclosed political targeting.
10 Election Polls, Estimates & Forecasts
Election polls and forecasts are research estimates, not certified election results. They may be based on information collected from a defined sample, during a specified period, using particular research methods and assumptions.
Research estimates may be affected by sampling variation, coverage limitations, nonresponse, questionnaire wording, respondent behaviour, changes in public opinion and other sources of uncertainty. Even carefully conducted studies cannot guarantee that a forecast will correspond to the eventual election outcome.
A poll conducted before an election measures information available at the relevant time. It should not be interpreted as a permanent statement of public opinion or as a representation that voters will necessarily act in accordance with their earlier responses.
Election predictions may involve additional analytical assumptions beyond the underlying survey responses. Users should distinguish the observed findings of a survey from estimates derived through subsequent analysis.
Only the competent electoral authority may determine and certify official election results. Users seeking definitive election outcomes should consult the relevant official records.
Moris Poll Pulse may retain original forecasts and compare them with subsequently published official results. Such comparisons should preserve the original publication date and content. Historical forecasts must not be retrospectively altered to create a misleading impression of accuracy.
To the extent permitted by applicable law, the operator does not guarantee that any election estimate, seat projection, vote-share estimate or forecast will prove accurate. This limitation does not excuse fraud, deliberate misrepresentation or other liability that cannot lawfully be excluded.
11 Research Methods, Quality & Interpretation
Research findings must be understood in relation to the methods used to produce them. The reliability and appropriate interpretation of a study depend on matters including the population of interest, recruitment method, sample composition, questionnaire design, fieldwork timing, response rates, weighting and other relevant characteristics.
A large number of responses does not necessarily establish that a sample represents the wider population. Similarly, a smaller study may be suitable for a narrowly defined research question when its methods and limitations are properly explained.
Where published findings include statistical estimates, users should consider the relevant uncertainty and methodological disclosures. Not every study permits a conventional margin of sampling error to be calculated, particularly where nonprobability sampling methods are used.
Research findings may change when new information becomes available, when the population changes or when a different research method is applied. Differences between studies do not necessarily demonstrate misconduct or error.
Users must not knowingly present research results in a way that materially changes their meaning. Percentages, charts, subgroup comparisons and quotations should be accompanied by sufficient context to avoid misleading interpretation.
The operator may correct factual errors, clarify methodology or publish updated findings where appropriate. Corrections should be distinguished from the original publication rather than silently changing historical research records.
12 Consumer, Brand & Institutional Research
Moris Poll Pulse may undertake research concerning consumer behaviour, brand awareness, product preferences, advertising effectiveness, customer satisfaction, institutional experiences and other commercial or social subjects.
Such research is intended to provide information about the respondents, populations or market conditions examined. Findings should not be interpreted as guarantees of sales, revenue, customer acquisition, investment performance or any other commercial result.
Consumer preferences may change over time and may differ between locations, demographic groups and purchasing circumstances. Research results therefore require interpretation within the scope and limitations of the relevant study.
Where a study includes product concepts, packaging materials, advertisements or other client-provided content, participants may be required to comply with reasonable confidentiality restrictions disclosed before participation.
The appearance of a third-party brand, product or organisation in research material does not automatically establish a sponsorship, commercial partnership or endorsement by that third party.
Research concerning employees, customers or institutional stakeholders may require additional safeguards to protect participants from inappropriate identification or adverse consequences. Those safeguards should be addressed in the relevant study arrangements.
13 Commissioned Research & Client Engagements
Organisations may contact Moris Poll Pulse to request research services. Submission of an enquiry does not oblige the operator to accept a project, provide a quotation or undertake any particular work.
A binding commercial engagement arises only when the relevant proposal, statement of work or agreement has been accepted according to its stated conditions. The agreement should identify the contracting entity, services, deliverables, fees, payment requirements, responsibilities, timelines and any applicable limitations.
Clients are responsible for providing accurate instructions and information reasonably necessary for the agreed work. Where clients provide personal information, contact lists or other materials, they must possess the necessary authority and lawful basis for doing so.
Changes to research objectives, respondent requirements, geography, questionnaire length, deliverables or other material conditions may require a revised agreement. The operator is not required to perform additional work outside the approved scope without the necessary authorisation.
Research timelines may depend on participant recruitment, fieldwork conditions, access to required information, client approvals and other legitimate factors. Any agreed timetable and consequences of delay are governed by the relevant contract.
Ownership and permitted use of commissioned research deliverables must be established in the applicable agreement. Payment for research services does not automatically transfer ownership of every underlying questionnaire, research method, software component, database or pre-existing intellectual property asset.
Nothing in these general Terms overrides a separately executed agreement that validly establishes different obligations for the particular project.
14 Fees, Billing, Cancellation & Refunds
Publicly accessible website information may be available without payment. Separate charges may apply to commissioned research, licensed reports, professional services, subscriptions or other expressly identified paid offerings.
No user should be charged for a service without an appropriate agreement or other valid authorisation. Any paid offering should disclose its relevant price, applicable taxes, billing conditions and material restrictions before the transaction is completed.
For commissioned research, fees and payment schedules are governed by the accepted proposal or contract. Additional costs, including specialist fieldwork, third-party data, travel or external services, should be addressed in the applicable commercial terms.
Cancellation rights and refund conditions depend on the nature of the service, the stage of performance, the governing agreement and applicable law. The operator may be entitled to payment for work properly performed or nonrecoverable costs where the relevant contract and law permit.
No provision of these Terms creates a blanket prohibition on refunds or excludes mandatory consumer rights. Where a statutory refund, cancellation or remedy applies, the relevant legal requirement takes precedence.
Payment disputes should be submitted through the designated commercial contact channel with sufficient information to identify the relevant transaction. The parties should attempt to review the issue in good faith before pursuing formal remedies.
15 Survey Incentives & Participant Rewards
Certain research studies may offer incentives to eligible participants. The existence, type and amount of any incentive must be expressly communicated in the relevant study invitation or participation information.
Registration for the Pulse Panel does not establish an entitlement to payment, points, vouchers, gifts or any other benefit. A member should not assume that every survey carries an incentive.
Where an incentive is offered, the applicable conditions should identify relevant eligibility requirements, completion standards, delivery arrangements and any material limitations. Such conditions must be lawful, transparent and administered fairly.
Reasonable fraud-prevention measures may be applied to identify duplicate participation, impersonation or deliberately fabricated responses. Incentives should not be withheld arbitrarily or because a participant expressed an unfavourable opinion.
Any applicable tax treatment depends on the relevant jurisdiction and incentive arrangement. Participants may be responsible for tax obligations imposed directly upon them by law.
No reward programme should be advertised as an active service until it has been formally approved and implemented.
16 Intellectual Property Ownership
The Platform may contain original written content, questionnaires, research reports, charts, tables, designs, illustrations, photographs, software, databases, trademarks and other materials protected by applicable intellectual property laws.
Unless expressly stated otherwise, intellectual property rights remain vested in the relevant lawful owner or authorised licensor. The availability of material on a public webpage does not transfer ownership or grant an unrestricted licence to reproduce or commercially exploit that material.
Users are granted a limited, non-exclusive permission to access publicly available content for lawful personal, editorial, educational or internal informational purposes, subject to applicable restrictions and statutory exceptions.
Commercial republication, substantial reproduction, redistribution of proprietary datasets, resale of reports or incorporation of protected materials into competing commercial products may require prior written authorisation.
Users must not remove copyright notices, alter proprietary research materials in a misleading manner or falsely claim authorship or ownership of content belonging to another party.
The names, logos and other distinctive identifiers associated with Moris Poll Pulse and Moris Media may be protected under trademark and related laws. Their display on the website does not authorise unrelated persons to use them in a manner that suggests sponsorship, affiliation or endorsement.
Nothing in these Terms restricts statutory copyright exceptions or other uses that cannot lawfully be prohibited by contract.
17 Research Reports, Datasets & Licensing
Published research reports may be made available for reading, downloading or reference under the conditions associated with the relevant publication. A report being publicly accessible does not necessarily mean that its underlying respondent-level dataset is available for unrestricted use.
Datasets may contain confidential information, licensed third-party material, proprietary research structures or information that requires privacy safeguards. Access may therefore be limited, refused or subject to a separate licence.
Where a data licence is granted, the licence should identify the permitted purpose, authorised users, duration, redistribution rights, confidentiality obligations and any applicable fees.
Users must not attempt to identify individual participants from anonymised or restricted research datasets where such activity is prohibited by law or the applicable agreement.
The operator may provide aggregated statistics, selected tables or methodological information without providing access to underlying individual records.
Any permitted reproduction of research should preserve accurate attribution and avoid materially misleading changes to the findings. Users should consult the relevant publication and licensing conditions before distributing substantial portions of a report.
18 Media Use & Editorial Attribution
Journalists, editors, broadcasters and publishers may refer to Moris Poll Pulse research in lawful editorial reporting, subject to applicable intellectual property rights and the need for accurate attribution.
When reporting research findings, media organisations should identify the relevant study, original publication date and research source. Where material to interpretation, reports should also disclose the fieldwork period, sample characteristics and important methodological limitations.
A polling estimate must not knowingly be presented as a certified election result. Similarly, a historical forecast should not be described as a prediction made at a different date from its actual publication.
Permission may be required to reproduce proprietary charts, substantial report extracts or restricted materials. Applicable statutory exceptions remain unaffected.
Media enquiries, interview requests and requests for unpublished data may be considered according to availability, confidentiality obligations and relevant legal restrictions. Submission of an enquiry does not guarantee access to unpublished information or an interview.
Moris Poll Pulse may request correction of materially inaccurate attribution or misleading representations of its research. Such requests do not prevent lawful criticism, independent analysis or legitimate journalistic scrutiny.
19 User-Submitted Content & Correspondence
Users may submit information through contact forms, media enquiry forms, research requests, survey questionnaires and other authorised communication channels.
Users represent that they have the necessary authority to submit the material and that their submission does not knowingly violate another person's rights or applicable law. Users should not provide unnecessary confidential records or personal information concerning third parties through general enquiry forms.
Information submitted through private correspondence may be processed for the purposes disclosed in the applicable notice. Submission does not automatically authorise public publication of the message or unrestricted use for unrelated commercial purposes.
Where users provide original materials for the purpose of obtaining a requested service, they grant the responsible operator the limited permission reasonably necessary to receive, review, store and process those materials for that purpose, subject to applicable law and contractual restrictions.
Ownership of user-created material remains with the relevant owner unless a valid separate agreement provides otherwise.
The operator may reject or remove unlawful submissions in accordance with applicable law and any relevant procedural requirements. Legitimate complaints, research criticism and lawful expressions of opinion should not be treated as prohibited content merely because they are unfavourable.
20 Confidentiality & Restricted Research Materials
Certain research activities may involve information that is confidential by nature or subject to express confidentiality obligations. Examples include unreleased product concepts, confidential questionnaires, restricted research datasets, client instructions and information relating to identifiable respondents.
Users who receive confidential materials under a valid agreement must use those materials only for the authorised purpose and must not disclose them to unauthorised persons.
Confidentiality obligations do not apply to information that is lawfully public, independently obtained without breach of an obligation or required to be disclosed under applicable law, subject to any lawful notice requirements.
The operator must also respect confidentiality obligations owed to participants and clients. A research client does not automatically acquire the right to obtain identifiable participant information merely because the client commissioned or funded a study.
Where confidential information must be shared with an authorised service provider, appropriate contractual and security arrangements should be maintained.
The duration and detailed scope of confidentiality obligations may be specified in a separate agreement. Nothing in these Terms prevents lawful whistleblowing, protected reporting or the exercise of statutory rights.
21 Personal Data & Privacy
The collection and processing of personal information in connection with the Platform are addressed in the applicable Privacy Policy and any relevant study-specific privacy notice.
Different services may involve different categories of personal information. General contact forms may request identification and correspondence details, while research activities may involve demographic information, consumer preferences or political opinions.
Information revealing political opinions or other sensitive characteristics may be subject to additional legal protections. Processing must satisfy the requirements applicable to the particular activity and jurisdiction.
Acceptance of these Terms does not automatically constitute valid consent for every form of personal data processing. Where consent is required, the relevant purpose and information must be disclosed and the necessary consent obtained.
Users may have rights to obtain information, request correction, withdraw consent, seek erasure or pursue other remedies under applicable law. The availability and scope of these rights depend on the relevant circumstances.
Privacy requests may be directed to privacy.pollpulse@morismedia.com once that address has been activated. The operator may require reasonable identity verification before disclosing or changing personal information.
These Terms must be read together with the Privacy Policy and do not replace legally required privacy notices.
22 Cookies & Similar Technologies
The Platform may use cookies and similar technologies for security, session management, account authentication, preferences, measurement and other disclosed purposes.
Certain technologies may be necessary to provide a service requested by a user. Other technologies, including some analytics or advertising technologies, may require prior consent depending on applicable law.
The Cookie Policy explains the relevant categories, purposes, consent arrangements and methods available to manage preferences.
Acceptance of these Terms does not automatically authorise the use of optional tracking technologies where separate consent is legally required.
The operator should not use ordinary website tracking to disclose identifiable political survey responses to unrelated advertising providers without a valid legal basis and appropriate safeguards.
Users may manage available cookie preferences through the relevant website controls. Blocking technologies necessary for a requested service may affect account authentication or other functionality.
23 Third-Party Services & External Links
The Platform may contain links to external websites, published research, media reports, payment providers, survey services or other resources operated by independent organisations.
Such websites may be governed by their own terms, privacy notices and technical practices. The inclusion of a link does not automatically establish sponsorship, endorsement or contractual responsibility for the external service.
Users should review the applicable conditions before providing information or entering into transactions with independent third parties.
The responsible operator does not control the accuracy, availability or subsequent changes to every external website. However, this provision does not exclude responsibility where applicable law imposes a duty in relation to the selection, integration or operation of a particular third-party service.
Where third-party providers process information on behalf of the operator, their responsibilities should be addressed through appropriate contractual and privacy arrangements.
24 Prohibited Conduct & Research Misuse
Users must not use the Platform for unlawful purposes or engage in conduct intended to compromise research integrity, participant confidentiality, website security or the lawful rights of others.
Prohibited conduct includes impersonation, deliberate falsification of research responses, unauthorised access to restricted accounts, distribution of malicious code, unlawful disclosure of personal information and deliberate manipulation of research participation records.
Users must not knowingly misrepresent Moris Poll Pulse findings, alter published figures to create false attribution or claim that unofficial polling information constitutes an official election result.
Restricted research materials must not be copied, sold or disclosed contrary to valid licensing or confidentiality obligations.
Users must not employ the Platform to intimidate respondents, suppress lawful electoral participation or engage in unlawful discriminatory practices.
These restrictions must be applied consistently with freedom of lawful expression, legitimate academic analysis, responsible security reporting, journalistic activity and statutory rights.
The operator may investigate suspected violations and take proportionate action where justified. Serious unlawful conduct may be referred to competent authorities when appropriate and legally permitted.
25 Service Security & Technical Protection
The responsible operator may maintain technical and organisational measures intended to protect website services, accounts, research information and related infrastructure.
Such measures may include authentication controls, restricted administrative access, security monitoring, session management, backups and procedures for responding to suspected incidents.
Users are responsible for taking reasonable precautions to protect their own credentials and devices. They should not knowingly attempt to bypass access restrictions or interfere with security measures.
The operator may temporarily suspend affected services where necessary to investigate an incident, contain a threat or protect information.
Security monitoring and related processing must comply with applicable privacy and other legal requirements.
No online service can guarantee that every technical failure, security incident or unauthorised attempt will be prevented. The operator remains responsible for meeting security obligations imposed by applicable law and any valid contractual commitments.
26 Publication Accuracy, Corrections & Updates
Moris Poll Pulse may publish research reports, statistical summaries, charts, forecasts and other informational materials based on available information and documented research activities.
Although reasonable care should be taken in preparing publications, errors, omissions or circumstances requiring clarification may arise. Users may report suspected inaccuracies through the relevant contact channel.
A correction request should identify the affected publication, the information in question and the basis for the concern. The operator may review the request against available source records and publish an appropriate correction or clarification where warranted.
Material corrections should be distinguishable from the original publication. In particular, historical election forecasts should not be silently rewritten after official results become available.
Research publications may be updated to incorporate additional information or revised analysis. An updated publication should not falsely imply that its revised findings were available at an earlier date.
Independent publishers remain responsible for their own editorial decisions, subject to applicable law. Nothing in these Terms prevents legitimate criticism or independent examination of Moris Poll Pulse research.
27 Informational Use & Reliance
Publicly available research materials are intended to provide information about the subjects, populations and circumstances examined in the relevant studies.
Research findings may inform public discussion, editorial reporting, institutional assessment and commercial decision-making. They should not be treated as guaranteed predictions or as substitutes for professional advice where such advice is necessary.
General research publications do not constitute personalised legal, financial, medical, investment or other regulated professional advice.
Users making consequential decisions should consider the limitations of the available research, the date of publication, the relevant methodology and other appropriate sources of information.
A commercial client receiving commissioned research may have specific contractual rights concerning professional performance and deliverable quality. Those rights are governed by the applicable agreement and law.
Nothing in this section excuses fraudulent representations, deliberate falsification of research or failure to meet legally enforceable professional obligations.
28 Warranties & Service Disclaimers
The Platform and publicly available informational services may be subject to interruptions, maintenance, technical limitations and changes in availability.
To the extent permitted by applicable law, the responsible operator does not warrant that public website access will be uninterrupted, that every technical defect will be immediately corrected or that every research estimate will correspond to future events.
Research findings necessarily involve assumptions, limitations and uncertainty. The operator does not guarantee particular electoral, commercial or institutional outcomes arising from reliance on general publications.
Where a separate commercial agreement provides express service warranties or professional commitments, those obligations remain governed by that agreement.
Nothing in these Terms excludes statutory guarantees, mandatory consumer protections or obligations that cannot lawfully be excluded. Any disclaimer must be interpreted consistently with the applicable legal requirements and the actual nature of the service provided.
29 Limitation of Liability
The responsibility of the operator for loss or damage arising from use of the Platform shall be determined according to applicable law, the nature of the relevant service and any valid separate agreement.
To the extent legally permitted, the operator may exclude liability for certain indirect or consequential losses arising from the use of general public informational materials, particularly where the user has relied upon research estimates as guaranteed outcomes despite clearly disclosed limitations.
The operator is not automatically responsible for losses caused solely by a user's unlawful conduct, unauthorised interference with services or independent decisions made by unrelated third parties.
For commissioned research, any agreed limitation of financial liability should be set out in the relevant commercial contract. No monetary liability cap is established by these general website Terms unless expressly and validly agreed.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where applicable, or any other liability that cannot lawfully be excluded.
Mandatory consumer protections, statutory privacy obligations and other non-excludable rights remain unaffected.
30 Indemnification
To the extent permitted by applicable law, a user who engages in unlawful conduct or materially breaches these Terms may be responsible for losses, claims or reasonable expenses directly arising from that conduct.
Any indemnification obligation must be interpreted according to the applicable legal requirements, including rules concerning causation, foreseeability, mitigation and fairness.
A user shall not be required under these Terms to indemnify the operator for losses caused by the operator's own unlawful conduct or for liability that cannot lawfully be transferred.
Where a separately negotiated commercial research agreement contains indemnification provisions, those provisions govern the relevant contractual relationship.
Any indemnification claim must be supported by an appropriate legal and factual basis. This provision does not create an unlimited obligation for consumers or research participants to reimburse every expense incurred by the operator.
31 Account Suspension & Termination
The operator may restrict, suspend or terminate access to a service where there are legitimate grounds involving material violations, security threats, fraudulent activity, unlawful conduct or other circumstances recognised by applicable law.
Where reasonably practicable, the operator should provide appropriate notice and an opportunity to address the concern before imposing a permanent restriction. Immediate action may be justified where necessary to protect security, confidential information or other users.
Restrictions must not be imposed merely because a user has expressed lawful criticism, submitted a legitimate complaint or exercised a statutory right.
Members may request voluntary account closure through the relevant procedure. Closure does not automatically cancel obligations under a separate commercial contract or require deletion of information that must lawfully be retained.
Where a paid service is terminated, the consequences for fees, deliverables and refunds are governed by the applicable agreement and mandatory law.
Users may contact the relevant support channel to request review of an account restriction.
32 Changes to Services & Terms
The operator may revise website features, research services and these Terms to reflect changes in law, technology, operational requirements or the nature of available services.
The current approved Terms should be accessible through the website and identify their effective date.
Material changes affecting existing contractual rights should be communicated in accordance with applicable law and the relevant agreement. Where affirmative acceptance is required, the operator should obtain it before applying the revised terms to the affected service.
A revision shall not retrospectively remove statutory rights or automatically alter a separately executed commercial contract unless a valid contractual provision permits the change.
Users who do not accept revised terms may discontinue use of the affected service, subject to any existing contractual obligations and applicable legal rights.
Previous versions should be retained internally to support accountability and the resolution of disputes concerning earlier periods.
33 Complaints, Grievances & Dispute Resolution
Users may submit concerns relating to membership, website access, research participation, publications, commercial services or other matters through the appropriate contact channel.
Complaints should provide sufficient information to identify the relevant service, transaction or publication. The operator may request reasonable clarification where necessary to investigate the concern.
Privacy-related complaints should be handled according to the applicable Privacy Policy and statutory requirements. Complaints concerning published research may require examination of the relevant source materials and methodology.
Where applicable law requires a designated grievance officer, prescribed complaint procedure or response deadline, the responsible entity must comply with those requirements and publish the relevant verified contact details.
The parties may attempt to resolve contractual disputes through good-faith correspondence before commencing formal proceedings. Such discussions do not remove a person's right to approach a competent court, regulator, consumer authority or other legally authorised body.
Any mandatory statutory complaint or appeal procedure remains available regardless of these Terms.
34 Governing Law & Court Jurisdiction
The governing law and competent courts must be determined by the responsible legal entity and approved before these Terms are published.
Governing Law: [Insert Approved Governing Law]
Competent Courts: [Insert Approved Court Jurisdiction]
Any choice of governing law or court jurisdiction shall operate only to the extent permitted by applicable law. It shall not deprive consumers or other protected persons of mandatory rights that apply notwithstanding the contractual choice.
Where a separate commercial agreement validly establishes different governing law or dispute resolution provisions, that agreement shall govern the relevant contractual dispute.
Privacy and regulatory matters may fall within the jurisdiction of authorities identified by applicable legislation, irrespective of the contractual jurisdiction provision.
These Terms do not impose mandatory arbitration. Arbitration may apply only where a valid, separately approved agreement establishes that procedure and applicable law permits its enforcement.
35 International Access & Legal Compliance
Moris Poll Pulse may be accessed by visitors from different countries. The availability and lawful operation of particular services depend on the relevant jurisdiction.
Users must comply with laws applicable to their own conduct. The operator must separately comply with laws applicable to its activities, including requirements relating to research participation, data protection, publication, intellectual property and commercial services.
Political research and election-related publications may be subject to specific local restrictions. The fact that material is accessible through the internet does not mean that every form of collection, publication or distribution is permitted in every jurisdiction.
Personal data processing involving international participants may require additional notices, safeguards or contractual arrangements.
Where translated versions of these Terms are provided, the responsible operator should identify the authoritative language version, subject to mandatory local language requirements and other applicable legal protections.
36 India-Specific Legal Considerations
Where activities are subject to Indian law, relevant requirements may arise under the Information Technology Act, 2000, applicable subordinate rules, intellectual property legislation, consumer protection legislation, election laws and data protection requirements.
The Digital Personal Data Protection Act, 2023 and its notified rules have phased commencement arrangements. Obligations must therefore be assessed according to the provisions actually in force at the relevant time.
Election research may be subject to restrictions under the Representation of the People Act, 1951 and applicable directions or requirements of the Election Commission of India. Particular care is required when conducting or publishing exit polls during restricted periods.
Any obligations that apply specifically to regulated intermediaries, publishers or other defined categories of online services must be assessed according to the actual legal classification of the Platform. These Terms do not assume that every category of regulation applies automatically.
Mandatory consumer rights, intellectual property protections and statutory remedies remain enforceable where relevant.
37 UAE & Other Jurisdictional Considerations
Where activities are subject to UAE law, the relevant operator must comply with applicable federal and other legal requirements concerning data protection, electronic transactions, commercial services and research activities.
Federal Decree Law No. 45 of 2021 concerning the protection of personal data may be relevant to certain processing activities, subject to its scope and applicable requirements. Different provisions may apply in specialised jurisdictions.
Research contracts involving UAE entities should identify the responsible contracting party, governing law, payment conditions and any relevant confidentiality or data protection requirements.
For services involving individuals or organisations in other countries, additional legal requirements may apply. These may include consumer rights, privacy legislation, research restrictions, advertising rules or local publication requirements.
The operator must not assume that compliance with the law of 1 country automatically satisfies the requirements of every jurisdiction in which services are offered.
38 Force Majeure & Events Outside Reasonable Control
Where applicable law and the relevant agreement permit, a party may be excused from or granted relief concerning certain obligations when performance is prevented by an event beyond its reasonable control.
Such events may include natural disasters, significant infrastructure failures, government restrictions, widespread telecommunications disruptions or other extraordinary circumstances that materially prevent performance.
A party seeking relief should take reasonable steps to reduce the consequences of the event and provide appropriate notice where required.
Ordinary commercial inconvenience, foreseeable staffing difficulties or a lack of funds should not automatically be treated as force majeure.
The consequences for payment, delay, suspension or termination of commissioned research must be determined by the relevant contract and applicable law.
This provision does not exclude obligations that remain enforceable despite the relevant event.
39 Electronic Communications & Formal Notices
The operator may communicate with users through email, authorised account interfaces or other methods disclosed for the relevant service.
Service communications may concern account verification, research invitations, security notices, enquiries, contractual matters or changes affecting an existing service.
Users are responsible for providing an accurate email address where email communication is necessary. The operator should take reasonable steps to use appropriate communication methods for important notices.
Ordinary email correspondence does not necessarily satisfy statutory requirements for formal legal notice. Where law or contract prescribes a particular method, address or period, that requirement takes precedence.
Marketing communications remain subject to applicable consent and communication rules. Acceptance of these Terms does not automatically authorise unrelated promotional messages.
The proposed contact addresses must be verified and activated before publication.
40 Severability, Waiver & Interpretation
If a competent court or authority determines that a provision of these Terms is invalid or unenforceable, the remaining provisions shall continue to apply to the extent legally possible, provided that doing so does not defeat the essential purpose of the agreement or mandatory law.
Failure by the operator to enforce a provision on 1 occasion does not automatically constitute a permanent waiver of the right to enforce that provision in another lawful circumstance.
Headings are included to assist navigation and do not independently alter the legal meaning of the provisions.
References to legislation include relevant amendments and subordinate instruments to the extent applicable, subject to the commencement and scope of the relevant provisions.
Any ambiguity must be interpreted in accordance with applicable contract law, consumer protections and other mandatory requirements.
No provision shall be interpreted as granting rights beyond those lawfully held by the responsible entity or as excluding duties that cannot be removed by agreement.
41 Entire Agreement & Surviving Obligations
These Terms, together with applicable incorporated notices and any valid additional terms, govern the relevant use of the Platform.
For commissioned research or separately contracted services, the executed agreement governs the particular commercial engagement and takes precedence where expressly applicable.
Termination of access or closure of an account does not necessarily terminate obligations that are intended to survive and are legally enforceable. Such obligations may include confidentiality, intellectual property restrictions, outstanding payment duties, lawful data retention requirements and dispute resolution provisions.
Survival does not authorise indefinite retention of personal information or impose obligations beyond what applicable law and valid agreements permit.
No employment, agency, partnership or joint venture relationship is created solely through website access, panel membership or ordinary survey participation.
